Welcome to IGNITE THE MIC (“IGNITE THE MIC,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of our websites, apps, community features, events tools, shop, podcasts, newsletters, and related services (collectively, the “Services”).
By accessing or using the Services, creating an account, placing an order, registering for an event, or subscribing to communications, you agree to these Terms. If you do not agree, do not use the Services.
1. Who may use the Services
You must be at least 16 years old to create an account, join the community, or subscribe to our newsletter. If you are under the age of majority where you live, you may only use the Services with the involvement of a parent or legal guardian who agrees to these Terms on your behalf.
You are responsible for providing accurate registration information and for keeping your login credentials secure. You are responsible for activity that occurs under your account.
2. Accounts and membership
Some features require an account or membership. We may offer free and paid membership options, verification badges, or other account tiers. We may suspend, limit, or terminate accounts that violate these Terms, applicable law, or community standards, or that create risk or legal exposure for IGNITE THE MIC or other users.
You may not share your account, impersonate another person, or use the Services for unauthorized commercial scraping, spam, or automated abuse.
3. Community, user content, and conduct
The Services may include profiles, posts, comments, messages, groups, listings, reviews, event pages, media uploads, and other user-generated content (“User Content”).
You retain ownership of your User Content. By posting or submitting User Content, you grant IGNITE THE MIC a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, adapt, and distribute that content as needed to operate, promote, and improve the Services.
You agree not to post or share content that:
- is unlawful, harassing, hateful, threatening, defamatory, or pornographic;
- infringes intellectual property, privacy, or publicity rights;
- contains malware, scams, or deceptive schemes;
- exploits minors or encourages self-harm or violence;
- is spam, phishing, or unauthorized advertising;
- violates another person’s confidentiality or applicable platform rules.
We may remove content, restrict features, or take other action we reasonably believe is appropriate. We do not pre-screen all User Content and are not responsible for it.
4. Events, RSVPs, and contributions
Event listings, RSVPs, tickets, and voluntary event support contributions are provided for community and programming purposes. Event details may change. Organizers and attendees are responsible for complying with venue rules and local law.
Unless expressly stated otherwise, event contributions are voluntary and may be non-refundable once processed. Ticketed purchases are subject to the refund and fulfillment terms shown at checkout or in the event listing.
5. Shop, merchandise, and payments
Products sold through our shop are described on product pages. Prices, availability, shipping estimates, and taxes may change.
Payment processing may be handled by third parties such as Stripe or PayPal. Their terms also apply. You agree to provide accurate billing and shipping information.
Except where required by law or stated at purchase, customized or print-on-demand items may be non-returnable once production begins. If an item arrives damaged or incorrect, contact us promptly at notify@ignitethemic.com so we can help with a replacement or remedy.
6. Podcasts, media, and editorial content
Podcasts, news, reviews, and other editorial or media content are for informational and entertainment purposes. Opinions expressed by hosts, guests, or contributors are their own unless clearly stated otherwise. Content may include affiliate links; we may earn a commission from qualifying purchases at no extra cost to you.
7. Newsletters and communications
If you subscribe to our newsletter or enable notifications, you consent to receive the communications you opted into. You may unsubscribe from marketing emails using the link in those messages or account settings. Transactional messages (such as order, security, or event confirmations) may still be sent when needed to provide the Services.
8. Intellectual property
The Services including IGNITE THE MIC branding, logos, site design, software, and our original content are owned by us or our licensors and are protected by intellectual property laws. You may not copy, scrape, reverse engineer, or exploit the Services except as allowed by these Terms or with our prior written permission.
9. Privacy, cookies, and analytics
Our collection and use of personal information is described in our Privacy Policy. Cookie preferences and analytics tools (such as Google Analytics, where enabled) are subject to your consent choices where required.
10. Third-party services and links
The Services may integrate or link to third parties (payment processors, maps, social login, print fulfillment, hosting analytics, and similar providers). We are not responsible for third-party sites or services. Your use of them is at your own risk and may be governed by their terms and privacy policies.
11. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free operation, or that content will always be accurate or complete.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IGNITE THE MIC AND ITS OPERATORS, OFFICERS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the maximum extent permitted by law.
13. Indemnity
You agree to defend and indemnify IGNITE THE MIC and its operators against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your User Content, your misuse of the Services, or your violation of these Terms or applicable law.
14. Suspension and termination
You may stop using the Services at any time. We may suspend or end access to all or part of the Services, including your account, if you violate these Terms or if we discontinue a feature. Provisions that by their nature should survive (including intellectual property, disclaimers, limitations of liability, and indemnity) will survive termination.
15. Changes to the Services or Terms
We may update the Services and these Terms from time to time. When we make material changes, we will update the effective date above and may provide additional notice. Continued use after changes become effective constitutes acceptance of the updated Terms.
16. Governing law
These Terms are governed by the laws of the United States and the State of New York, without regard to conflict-of-law rules, except where mandatory consumer protections in your place of residence apply. Courts located in New York may hear disputes arising from these Terms, subject to applicable law.
